I JUST Sued CNN over Censoring the Trump vs Biden Debate.
FULL TRANSCRIPT
we have just filed a lawsuit against CNN
for their unamerican censorship of
Independent Media outlets on a very
historic night the Trump versus Joe
Biden presidential debate it is
currently 112 a.m. on the morning of the
debate we have just finished compiling
our lawsuit and we are seeking an
emergency injunction to make sure you
get Fair access to commentary
about this debate CNN right now desires
unchecked power to control 50% of the
presidential debates we're expecting to
get in the 2024 election it's a nasty
power grab and
unfortunately CNN might get away with it
unless we stop them this is not about
left versus right this isn't about a
Democrat or
Republican this is about America and CNN
being
anti-democratic
anti-American that's why again just
moments ago we filed a substantial
lawsuit against CNN and we're asking for
your help we're hoping you could share
this and let anybody you know know that
there is now a lawsuit against CNN and
all we're asking is that they allow
independent journalists and anybody who
wants to comment on the debate live
stream to allow them to exercise their
first amendment privilege to comment and
to provide insight to anybody who wants
so that way if you want to flip between
CNN or Fox and you want to hear Fox
commentary during the debate you can do
that you want to flip over to listen to
my buddy Tim Po or my friends over at
breaking points you want to listen to
Patrick B David or you want to listen to
what Kevin has to say during the debate
or you want to flip between all of us
while we're streaming the debate you
would be able to if we can get the
injunction we need we're filing this
lawsuit to get an emergency hearing
we're not asking for money we're just
asking for your help in getting the word
out so that way we can hopefully
hopefully get a federal court to look at
our injunction request and Grant it
before the debate we've got to move fast
so right now before we get into some of
the details of the lawsuit if you can

whatever you got to do for the algorithm

speech I stand for free speech and we're
just here to fight the good fight to
make sure free speech and independent
journalists are allowed to comment on
the debate this doesn't just affect me
it affects everyone neutral Left Right
Center it does not matter and we're not
asking for a dime from anyone there's no
GoFundMe this is lawsuit this entire
lawsuit is on us we'll fight it and
we'll pay for it it's just the right
thing to do so here's the Crux of the
issue for the first time since 1988 CNN
will be hosting its own presidential
debate without the oversight of the
nonpartisan group called the commission
on presidential debates that Commission
in a nonpartisan way helps set rules
they pick moderators they ensure the
debate is fair and they ensure that
practices during the debate are fair not
just for commenters outside the debate
but the way the debate is structured as
well but for some reason CNN decided not
to follow something that we've been
doing for over 30 years coming up on 40
instead CNN's hosting just one of the
two presidential debates we're having so
about 50% and it's somewhat weird that
it's happening 131 days before the
election which is quite unusually early
but it has the potential to really sway
political discourse over the next few
months until the next debate see CNN is
only allowing certain other companies to
broadcast the live stream of the debate
but even those companies like let's say
fox or NBC even they are not allowed to
comment on the debate during the debate
no one who streams the debate is allowed
to comment this is crazy if somebody
says something crazy or somebody wants
to throw in a quick fact check like hey
here's a quick you know by the way it's
25% instead of 15% whatever the number
is and a quick little fact you throw
some data up on the screen it just helps
people during the most critical time
when the debate happens I expect that
people are going to be together with
their families their friends they're
going to watch the debate and the best
time to get commentary is during the
actual debate in those low moments when
the moderators yapping about rules or in
the commercial breaks those are great
times or even quickly if somebody says
something outrageous to fact check it
during the debate is the most important
moment to get fact checks and commentary
out there for those who want it at least
let people have the option if somebody
wants a stream with zero commentary at
all go watch it on CNN but people
deserve the right to have their choice
of
commentator this is so unamerican to
strip the First Amendment rights that we
have to free
speech no independent journalists or
YouTubers are being allowed to stream
the debate in fact some have even
alleged that CNN is trying to go as far
as forcing YouTube to take downstreams
of the debate when independent
journalists have reached out like
breaking points or Tim poool they've
either been disallowed from streaming or
have just been straight up rejected from
CNN on top of this CNN wants the right
to no studio audience and have the
ability to mute candidates mics so
literally CNN has complete control they
could silence Trump or Biden so mostly
Trump whenever they want at their whim
and nobody else in the audience because
there is nobody in the audience could
hear what they're
saying to broadcast it we we totally at
CNN's whim and it's really important
that commenters especially with those
sort of rules are able to go oh it looks
like you know someone's trying to
dispute with this maybe we could try to
somewhat hear what he's saying you know
or read his lips or something I I don't
know it's crazy I don't think we've ever
seen this technology of muting mics
before I mean I get it they're trying to
have it attempted maybe to make it a
little bit more orderly but part of what
makes debates alive is the respect or
lack of respect the candidates show
towards each other that's part of the
qualification
process so to me this is all extremely
scary it's unpatriotic and it doesn't
help people feel that our elections are
trustworthy this hurts election
Integrity this is unamerican It's
censorship it's corporate
discrimination it violates the Sherman
Anti-Trust Act it violates the rules of
the Federal Communication commission it
violates the principles and doctrines of
fair use it's
anti-American it violates one of the
most important days in history a night
where Americans will evaluate or start
evaluating who will lead our country in
the next four
years this will drive all presidential
discussion for the next months and it's
critically
important so we're not asking for
anything more than the right to during
the
stream share the restream while adding
transformative commentary that's all
we're asking we just want to be able to
add our commentary to the
stream it's very simple we've done it
for decades can we almost say that on
YouTube now decades
all I certainly did during January 6th
streamed live for 10 hours that day
covered Trump's speech into everything
else that happened that day because
that's what we
do Americans all around the country have
become
accustom to getting perspective from
commentators and substantially fewer
people watch commentary after the fact
so what I encourage is sharing this and
making it known retweet this make sure
everybody knows we are suing CNN for
free speech and we're not going to stop
until we have it because if we don't
we're going to fall into communist ISM
now let's take a quick look at the
actual case this is the highlighted
version I will as soon as I can get it

actual filed lawsuit with the uh case
number once it gets assigned so uh we
are bringing this action for violations
of the Federal Trade Commission act the
Sherman Antitrust Act the public for
Doctrine the First Amendment and the
communications Act of
1934 for their refusal to allow others
to comment on the presidential debate
which we argue constitutes monopolistic
Behavior restricts public discourse and
violates the principle of Fair
competition and public interest
obviously as well the protections under
the fair use Doctrine so uh the case has
a lot of background we go into a lot of
detail for example we have this here
this is not the first time CNN has
restricted Mr af's freedom of
speech during the California
gubernatorial campaign for example we
had to send them a cease and deist
letter because they ran an article on
their homepage that there was nobody
challenging Gavin new some from the
governor's party and that was factually
false we were actually winning in the
polls at that point didn't win for
governor because the recall didn't end
up happening should have happened
oh well but anyway we were winning at
the poll we were beating Larry Elder in
the polls at that time anyway um we've
had some history with CNN and censorship
and so we argue that uh what they're
trying to do by silencing smaller
creators and smaller independent
journalists is they're trying to control
and contain The Narrative of this debate
to exactly what they want and so we
think this is Corporate a discrimination
an un fair business practice uh so we
call this unfair competition under the
Federal Trade Commission act uh we say
this is essentially stifling critical
commentary at the time of the debate
which is akin to censorship our second
claim is the violation of Anti-Trust
laws under the Sherman Antitrust Act and
one of the uh quotes that we use is from
Associated Press versus United States
the freedom to publish means a freedom
for all not for some
every person who shall monopolize or
attempt to monopolize any part of trade
or Commerce which news is trade it's
interstate trade uh among several States
shall be deemed guilty of a
felony the US Supreme Court has stated
there is substantial governmental and
First Amendment interest in promoting A
diversity of views provided through
multiple technology media keep in mind a
lot of these cases come from before even
the days of of the internet broadcasters
must operate in the public interest
that's under our fourth claim violation
of the communications Act of
1934 and then our fifth claim is
violation of public policy in addition
to of course the fair use
Doctrine well folks we certainly hope
that we can resolve this in an American
way we need True Justice to be served
