0:00

hey everyone me Kevin here the IRS just

0:01

released a new update on the $600 venmo

0:04

and PayPal rule a lot of people have

0:06

been asking about the details for this

0:08

and here's the latest first of all it's

0:10

been delayed this is good news for a lot

0:13

of folks who were wondering if they were

0:14

going to get a $199 K yeah in case you

0:17

haven't heard of it yet there's this

0:19

thing called the third party T

0:21

settlement organization rule it's

0:24

basically a fancy way of the IRS saying

0:26

we want to tax you when you get paid

0:29

anything over $600 through things like

0:33

venmo PayPal uh it could be as much as

0:36

uh $600 on Etsy for being a seller eBay

0:41

Airbnb anything you get paid over $600

0:44

for organizations that pay you that

0:47

money have to file a

0:49

$10.99 K by January 31st of each year

0:55

for the prior year so basically if you

0:58

got paid say say $2,000 from your buddy

1:03

and they were just reimbursements in

1:05

aggregate amounts then there's a chance

1:07

they could show up as something that

1:10

needs to be reported on a 1099 K which

1:13

means you have to report it as income on

1:15

your taxes and then that means you need

1:17

to come up with offsetting expenses

1:19

otherwise you're paying taxes on this

1:21

sort of stuff it's a disaster now the

1:23

critical way to separate liability for

1:26

these $600 reporting requirements is

1:29

when you're sending or receiving

1:31

payments and they're personal payments

1:33

make sure they're sent as a personal

1:34

payment the goal of this IRS rule is to

1:37

basically capture payments that side

1:40

hustle people get so for example maybe

1:42

you hung christas Christmas lights for

1:45

uh you know a bunch of people or you did

1:46

yard Duty for somebody or uh you know

1:49

you did some electrical work or some

1:51

Plumbing work on the side those are the

1:53

sort of amounts in excess of $600 when

1:56

they get processed as a payment to a

1:58

business that the the government is

2:00

saying hey we want to capture taxes on

2:03

this so we're going to make businesses

2:05

uh that uh support these sort of

2:07

payments again Airbnb Etsy venmo Paypal

2:11

report to the IRS when payments of over

2:14

$600 were made to one particular party

2:18

that's how they're calculating it it's

2:19

going to be based on one particular

2:20

party in aggregate now the IRS just came

2:23

out just released a statement that they

2:25

are actually going to delay this by

2:27

about a year uh the way they suggest is

2:30

that 2023 will be considered a

2:32

transition year which removes the

2:34

requirement of reporting transactions

2:37

over $600 that were categorized as for

2:39

business to the IRS now there is an

2:42

exception to that rule any transactions

2:46

over I believe it's

2:48

$20,000 yeah here it is look at this

2:50

originally enacted in 2008 there is

2:53

still going to be a requirement for any

2:55

transaction that exceeds

2:58

$20,000 or or the number of transactions

3:02

with one particular party

3:05

exceeds 200 so for example if somebody

3:08

paid you every single day for

3:11

babysitting your children and you paid

3:14

them in the four business measure let's

3:17

just say theoretically right and you

3:19

paid them every single day for 200

3:21

transactions that would apply as would

3:23

payments over $20,000 more realistic

3:27

this 200 transaction count would be a

3:29

way to say Hey you had $250 transactions

3:34

let's say which is 10 grand you're

3:36

selling stuff on Etsy we want taxes on

3:39

that 10 grand right that would be the

3:40

more realistic way to implement or to

3:43

expect that to actually end up being

3:45

taxable so there is a way that uh you

3:48

could still get reported by Etsy or

3:50

Airbnb or otherwise if you have more

3:51

than 200 transactions or

3:54

20,000 otherwise business payments of

3:57

over $600 in a agregate that's in total

4:01

to a specific

4:03

paye will be reportable in

4:07

2024 unless of course they kick the can

4:09

down the road again the good news about

4:12

this is it basically gives you more time

4:14

to separate your personal and business

4:16

venmo and PayPal transactions basic

4:19

bottom line is as you go into 2024 just

4:22

make sure you know when you're sending

4:24

somebody a payment as a for business not

4:27

only are there usually Chargers

4:29

associated with that but you're probably

4:31

going to be triggering this 1099 k for

4:34

this is also important for those people

4:36

who are operating side hustles where

4:38

they're regularly getting paid they're

4:39

on Etsy they're on Airbnb or otherwise

4:42

but for now it's delayed by another year

4:45

thanks so much for watching this update

4:47

and yeah I lost a bed on my hair with

4:49

myself I made a mistake we'll see you

4:53

soon Happy Thanksgiving everyone bye
