0:00

wow the Donald Trump strategy to defeat

0:03

the hush money trial against him just

0:06

got really interesting let's go through

0:09

this first let me catch you off to speed

0:11

my goal is to cover this entire trial

0:13

I'm just going to give you a quick

0:14

background so if you're already used to

0:16

the background I'll put a little time

0:18

stamp down below you could skip forward

0:19

to the interesting part but let's just

0:21

give you a little quick background we'll

0:22

make it simple just so you know the

0:24

names of people involved and what's

0:26

going on so when you hear Alvin Bragg I

0:28

want you to think district attorney when

0:31

you hear Matt I want you to think the

0:34

prosecutor he's the guy actually in the

0:36

courtroom pound in the pavement for

0:39

Alvin brag when you hear Leticia James

0:42

think of a state of New York attorney

0:46

general these names sometimes blend

0:48

together so I'll add some reminders so

0:51

keep in mind that this entire case is

0:55

designed to paint what Donald Trump did

0:58

as a criminal conspir iry and a coverup

1:02

to influence the election now the Trump

1:05

campaign's response to this is pretty

1:06

remarkable already in their opening

1:08

statement so we're going to hit that as

1:09

far as some other names that are going

1:11

to be important David pecker CEO of the

1:14

company that owned the national Inquirer

1:16

stormmy Daniels who signed a statement

1:18

in 2018 January 30th 2018 stating she

1:22

never had an affair with Trump but then

1:24

she later said that wasn't her signature

1:26

and then in a different case said that

1:28

okay was her signature but she had no

1:30

choice because she was uh forced to sign

1:33

the statement via a non-disclosure

1:35

agreement in exchange for accepting the

1:37

$130,000 and felt like she had no choice

1:39

to accept $130,000 so that'll come up

1:42

that all relates to of course her

1:44

allegations that the national Inquirer

1:46

was thinking about taking public which

1:48

then she recanted and kind of kept her

1:51

story uh hushed up if you will because

1:54

allegedly she made a deal with Trump

1:56

you'll hear Todd blanch he's the Trump

1:59

defense attorney now this guy is really

2:01

interesting because he has a history of

2:04

being a federal prosecutor in Manhattan

2:07

which is interesting because now he's

2:09

playing defense attorney in other words

2:11

he used to be the guy working for

2:13

Manhattan now he's the guy working for

2:15

the defendants against Manhattan so it's

2:17

kind of a really interesting flip-flop

2:19

of a role he has limited experience as a

2:21

defense attorney and he also helped Paul

2:23

manord avoid avoid State charges of

2:26

mortgage fraud so somehow hooked up with

2:29

Donald Trump and here we are so the idea

2:32

probably is that Trump's got a guy who

2:34

used to work for the state and knows how

2:35

they operate right that's the idea then

2:38

you've got uh judge M I like to call him

2:40

work judge M I call him judge M he's the

2:44

justice of uh a Justice of the New York

2:46

state supreme court in Manhattan he is

2:49

not only presiding over the hush money

2:51

trial but he also previously oversaw the

2:53

5we trial against the Trump Organization

2:56

for tax fraud which the Trump

2:58

organization was convicted icted of 17

3:00

counts he also oversaw the tri trial of

3:03

Alan velber the former Financial chief

3:08

of the Trump organization who plad

3:10

guilty to a 15y yearlong tax fraud

3:13

scheme judge am sentenced Allen to five

3:17

months at Riker's Island all right then

3:21

of course you've got to know Michael

3:23

Cohen now here's another interesting

3:25

character everybody's got an interesting

3:27

kind of story because Michael C actually

3:30

pled guilty to lying to Congress lying

3:33

in court and lying to the media he

3:36

actually went to prison he was sentenced

3:38

to 3 years in prison and ordered to pay

3:41

$50,000 and then got disbarred so he can

3:44

no longer be an attorney he went to

3:46

prison in 2019 and got out in 2021 so he

3:50

spent Co in prison anyway this guy's

3:53

like 57 years old at one point Donald

3:55

Trump sued Cohen for breach of legal

3:57

trust because of that audio recording

4:00

against uh Donald Trump or that people

4:01

are trying to use against Donald Trump

4:03

I'll explain that in a moment uh and

4:05

then of course he's now being used as a

4:06

key witness against Donald Trump that's

4:09

because of I'm not going to play the

4:10

audio recording because I'll show you

4:12

why Donald Trump's defense kind of

4:13

messes all of that audio recording stuff

4:16

off but basically there's this audio

4:17

recording where Michael Cohen's like hey

4:20

so I'm going to set up a shell company

4:22

I'm going to make the payments to deal

4:24

with the pecker issue that's the

4:25

national inquire story referring to

4:27

Stormy Daniels okay so that's really

4:29

just just like a catchup of everything

4:31

and Michael Cohen recorded that why he

4:33

recorded that who knows but he did and

4:35

you hear Trump kind of you know going

4:37

along with it whatever okay none of that

4:39

is necessarily wrong what's wrong is

4:42

what the district attorney alleges and

4:44

that's 34 counts of basically writing uh

4:48

checks invoices and documenting items in

4:53

like quick books like a ledger uh saying

4:56

these are normal necessary and ordinary

4:58

legal business expenses is that's what

5:01

the Trump organization claims and the

5:03

district attorney is claiming no those

5:05

expenses were used to cover up something

5:08

that the electing the voting public

5:10

should have known of therefore not only

5:12

did you lie about a business expense

5:15

being a business expense which would be

5:16

a misdemeanor but you used it to cover

5:19

something else up and that rises to a

5:21

classy felony which is the lowest form

5:23

of a felony uh so the argument is you

5:26

paid off Stormy Daniels through your

5:27

family trust via Michael Cohen Cohen has

5:31

admitted to such okay so what is the

5:34

Trump defense and this is where things

5:36

get really interesting so you just had a

5:38

good little four minute-ish five

5:40

minute-ish catch up on everything that's

5:42

being uh alleged those 34 counts by the

5:45

way come out of uh three different

5:47

situations the payment to Stormy Daniels

5:49

the deal with Karen McDougall and the

5:50

30k payment to the doorman who alleged

5:53

that Donald Trump fed a child out of

5:54

wedlock okay there now we're fully

5:56

caught up so today

6:00

we started hearing opening statements

6:03

and this is where we got a really

6:05

interesting point of view from the Trump

6:07

defense and that's what we've got to

6:09

talk about uh first worth getting out of

6:12

of the way that Matt the prosecutor

6:14

suggested that Donald Trump is a penny

6:16

pincher that he approves every invoice

6:18

and that Trump never negotiated Cohen's

6:21

price instead Trump doubled the price

6:23

Cohen was charging because he wanted

6:25

this issue to go away now the Trump

6:28

defense here is is like really really

6:32

fascinating okay so you ready for this

6:34

I'm going to set this up let's assume

6:37

for a moment that Trump did something

6:41

wrong with Stormy Daniels and then

6:43

covered it up well then these

6:46

allegations you know they could have

6:47

some

6:48

weight but what if you argue all that

6:52

stormy Daniel stuff was all a lie and

6:56

therefore all of the other expenses that

6:59

happened

7:00

the invoices the legal expenses the

7:02

reimbursements the shell company the

7:04

audio recording all of that doesn't

7:08

matter because we were just simply

7:11

paying for a false story to go away so

7:15

we wouldn't have to publicly defend a

7:17

false story right before the

7:20

election now that is a really

7:23

interesting twist I was not expecting

7:26

this see I was expecting that the state

7:28

was going to come in and say Donald

7:30

Trump knew about these expenses which

7:32

they did say today Donald Trump knew

7:34

about these expenses and he had an

7:36

affair and he used this money to cover

7:38

up that he had an affair that's what I

7:39

was expecting the defense or the the

7:41

prosecution to say and I thought the

7:43

defense would come in and say Donald

7:45

Trump knew nothing about these payments

7:47

which would be problematic because they

7:49

have that audio recording that the FBI

7:51

got their hands on right but Trump's

7:55

defense is going 4D chess move and

7:58

saying you know what yeah that audio

8:01

recording we own it you know what we did

8:05

make payments to Stormy Daniels in fact

8:08

all those invoices the checks we wrote

8:11

and The Ledger absolutely right those

8:14

were a necessary an ordinary business

8:16

expense because stormmy Daniels came up

8:19

with a false story and it is not illegal

8:23

to pay somebody to shut up about a lie

8:27

instead she's the criminal because she's

8:29

storting us with a defamatory lie now

8:32

that is such an interesting argument

8:34

because it changes everything here it

8:37

basically lets Donald Trump lean into

8:40

all of the fraud charges about the

8:43

general ledger the checks and the

8:46

invoices and it allows Michael Cohen to

8:49

say yep we paid her and then he can go

8:52

up on the stand and say we paid her

8:54

Donald Trump agrees we paid her Donald

8:56

Trump will go yep yep we paid her and

8:58

then when Michael Cohen gets asked well

9:00

did Donald Trump have an affair with her

9:02

how am I supposed to know and then

9:03

Donald Trump's going to go I didn't have

9:04

an affair with her and then stormmy

9:06

Daniel is going to go I had an affair

9:07

with him and so then this whole case

9:10

doesn't actually come down to the

9:13

payments what it actually comes down to

9:16

is do you believe Donald Trump had an

9:18

affair with her or not which which then

9:23

all of a sudden this case is like what

9:27

this is like you know the the case of

9:31

probably this year right the case of

9:34

2024 uh public trial of a former

9:36

president uh and it kind of reminds me

9:38

of very much like Bill clintones like

9:40

you know I did not have sexual relations

9:42

with like it reminds me a lot of the

9:44

Monica Lewinsky scandal and so this is

9:47

like wow we are no longer actually

9:50

arguing about whether or not these

9:52

checks were made or invoices were made

9:54

or the tapes or uh you know whether or

9:57

not stormmy Daniels uh statement was

9:59

true or or or false like her written

10:01

statement right what we're actually now

10:03

asking the jury to do is do you believe

10:06

that Donald Trump had an affair if he

10:09

did not have an affair then all of the

10:11

stuff that came after that not illegal

10:13

as Trump's defense says that is a

10:16

legitimate use of money to defend

10:19

against a false story and it is not

10:22

election interference and you know what

10:24

it is not illegal to influence an

10:26

election by covering up false lies like

10:30

you're under no obligation to tell

10:32

somebody something if it's a lie because

10:35

you're just reiterating somebody's lie

10:37

that's very very interesting it's a very

10:39

interesting defense and it totally

10:41

contrasts with a what I thought we were

10:43

going to get going into this but it's

10:45

also going to then lead jurors to have

10:47

to decide okay so how credible is

10:51

stormmy Daniel's story because really

10:53

you just basically can put Michael Cohen

10:55

up there and he's going to say yeah we

10:58

were the checks but now all going to

10:59

come down to what evidence the Stormy

11:01

Daniels have that an affair actually

11:03

occurred and that is going to be used if

11:07

there's a lack of evidence or a lack of

11:10

you know uh the stained dress so to

11:12

speak or text or whatever it's going to

11:15

be pretty hard to get Trump now again of

11:21

course the prosecution is going to try

11:23

to set up a challenge against Donald

11:25

Trump's credibility so what they're

11:26

going to do is they're going to come

11:28

after his is uh assets case this is

11:31

basically where there's the allegation

11:33

that Donald Trump inflated assets so

11:35

they're going to go after him uh for

11:37

that they'll bring that up uh and they

11:38

will bring up uh any other potential uh

11:43

issues or misstatements that have

11:45

occurred such as Donald Trump's

11:47

compliance with gag orders and his

11:49

defaming of Jean Carroll which obviously

11:51

Jee Carroll won a lot of people like

11:54

trumped didn't def whatever all of those

11:56

things are going to come up because what

11:58

the prosecution is going to try to do is

12:00

break down Trump's credibility and pump

12:03

up the credibility of stormmy Daniels

12:06

and on the other side they're just going

12:07

to be trying to collapse stormmy

12:10

Daniel's credibility and boost their own

12:13

so this is wild because it's really

12:16

going to come down to an opinion of a

12:19

jury and the trial actually ended early

12:22

today because apparently one of the

12:23

jurors had a toothache you can't make

12:26

this stuff up anyway if you like my
